Welcome to Personas.Work (“Personas,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of the Personas.Work website, platform, and any related services (collectively, the “Service”). By accessing or using our Service, you (“User,” “you,” or “your”) agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Who We Are

Personas.Work is operated by Pluggdd Mobile OPC Private Limited, located at Villa 67, Highland Villas, BB Borkar Road, Goa, India - 403101. We provide an online platform that allows you to analyze uploaded documents for insights, risk identification, and persona-based reviews using Artificial Intelligence.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements and that all information you provide is accurate.

3. Account Registration

You must register for an account to access most features. You agree to provide accurate and current information during registration and keep your account credentials confidential. You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized use.

4. Use of the Service

a. Service Description: The Service allows you to upload documents (PDF, DOC, DOCX). Our system, utilizing AI technology (including the Google Gemini API), processes the content to generate summaries, identify parties, suggest relevant questions (levers), and provide analysis based on your answers and perspective.

b. Coupons: Use of the Service for document processing requires "coupons." Each page processed consumes one coupon. Coupons can be obtained through signup promotions or purchased via the Service. Coupons have no cash value and are non-transferable.

c. Acceptable Use: You agree to use the Service lawfully and ethically. You will not:

  • Upload documents you do not have the right to process or that contain illegal, harmful, or infringing content.
  • Attempt to interfere with, disrupt, or compromise the Service's integrity or security.
  • Use the Service for any purpose prohibited by law or these Terms.
  • Attempt to reverse-engineer the AI models or underlying technology.
  • Share your account credentials or allow others to use your account.

d. Service Availability: We strive to keep the Service available but do not guarantee uninterrupted access. Maintenance or unforeseen issues may cause temporary downtime.

5. Document Handling, Privacy, and AI

a. Ownership: You retain all ownership rights to the documents you upload.

b. Processing: You grant us a limited license to process the content of your uploaded documents solely for the purpose of providing the Service's analysis features to you. This includes sending the content to our AI service provider (Google Gemini API) for processing.

c. Confidentiality & Privacy: We treat your uploaded documents as confidential. Our data handling practices are detailed in our Privacy Policy. We implement security measures to protect your data.

d. No AI Training: As stated in our Privacy Policy, your specific document content is **not** used to train Google's public AI models or any other general-purpose AI.

e. User Responsibility: You are responsible for ensuring that your use of the Service, including uploading documents, complies with any confidentiality obligations or data protection requirements applicable to the content of those documents.

f. Data Deletion: You have control over your documents and can delete them and their associated analysis from the Service as described in our Privacy Policy and FAQs, including the immediate 'Export & Delete' option.

6. Intellectual Property

Excluding your uploaded documents, all content, features, functionality, trademarks, logos, and software associated with the Service are the exclusive property of Personas.Work or its licensors. These Terms do not grant you any rights to use our branding or intellectual property except as implicitly necessary to use the Service.

7. Disclaimers

a. NO LEGAL OR FINANCIAL ADVICE: Personas.Work is an informational tool. The analysis, summaries, risk ratings, suggestions, and any other output provided by the Service DO NOT CONSTITUTE LEGAL, FINANCIAL, OR PROFESSIONAL ADVICE. The AI analysis is based on patterns and user input but cannot understand the full context or legal implications specific to your situation. You MUST consult with qualified legal counsel, financial advisors, or other relevant professionals before making decisions based on the Service's output.

b. "AS IS" BASIS: The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be accurate, complete, reliable, error-free, secure, or uninterrupted, nor that the AI outputs will meet your specific requirements.

c. AI Limitations: You acknowledge that AI systems have inherent limitations, may produce errors or unexpected results, and their outputs should be independently verified.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PERSONAS.WORK AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SERVICE OR YOUR RELIANCE ON ANY INFORMATION OR ANALYSIS PROVIDED BY THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE TOTAL AMOUNT PAID BY YOU FOR THE SERVICE IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100 USD).

9. Indemnification

You agree to indemnify, defend, and hold harmless Personas.Work and its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, your infringement of any third-party rights, or the content you upload.

10. Modifications

We reserve the right to modify or discontinue the Service (or any part thereof) at any time. We also reserve the right to modify these Terms at any time. We will provide notice of significant changes (e.g., by posting on the website or via email). Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

11. Termination

We may suspend or terminate your access to the Service immediately, without prior notice or liability, if you breach these Terms or for any other reason at our discretion. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service will cease immediately. Provisions related to intellectual property, disclaimers, limitations of liability, and indemnification shall survive termination.

12. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of India, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Goa, India.
